Be aware of Predatory Lending tactics:

Buying or refinancing your home is one of the most important, yet most complex financial decisions you will ever make. There are many lenders, appraisers, and real estate professionals out there who are prepared to help you find a nice home and a great loan; however, you need to understand the home buying process in order to become an enlightened consumer. Every year, misinformed homebuyers, often first-time purchasers or seniors, become victims of predatory lending and loan fraud. 

Don't let this happen to you! The best defense against predatory lending is education. Understanding homeowner rights and the home buying process is an important first step in protecting families and their homes.

Here are a Dozen Tips for Avoiding Home Buying Pitfalls:

1. Say NO to "easy money." Borrowers be aware if someone claims "credit problems won't affect your interest rate." If a solicitation for a loan sounds too good to be true, it probably is. If a solicitation still appears to be interesting, get it in writing!

2. Be aware of prepayment penalties.  Borrowers should know if the loan offered to them has a prepayment penalty. A prepayment penalty is a choice, not a requirement.

3. Ask about additional fees. Borrowers should question any items they didn't ask for; for example, borrowers should be aware that if they are told single premium credit insurance is required get a loan, or that purchasing it will help the loan approval, this is not the case for credit insurance is optional. Review fees and compare different lenders' fees to ensure you are getting competitive loan terms. 

4. Protect home equity.  If borrowers are taking equity out of their property, they should only take out the minimum amount required to meet present financial needs. The equity in your home is a source of wealth, which builds up slowly over time.

5. Interview several real estate professionals. Ask for and check references before you select a realtor to help you with buying or selling your home, then gather information about the prices of other homes in the neighborhood. Don't be deceived and end up paying too much for a home.

6. Hire an experienced and licensed home inspector to carefully inspect the property before you sign and accept a final offer-to-purchase agreement. Determine whether you or the seller is going to be responsible for paying for repairs. If you have to pay for these costs, determine whether or not you can afford to make them before signing and accepting the final offer. 

7. Shop for a lender and compare costs. Be suspicious if anyone (especially someone that has a vested interest in the consummation of the mortgage transaction) tries to steer you to just one lender. 

8. Make sure all documents are correct. Do NOT let anyone persuade you to make false statements on your loan application, such as overstating your income, the source of your down payment, failing to disclose the nature and amount of your debts, or how long you’ve been employed. When you apply for a mortgage, every piece of information you submit must be accurate and complete. False statements and misrepresentations on a mortgage application are fraudulent and could result in prosecution and criminal penalties. 

9. Do NOT allow anyone to convince you into borrowing more money than you actually need or feel comfortable with being able to repay. If you get behind on your mortgage payments, you not only risk losing your home, but any money you’ve invested in it, your peace of mind and most important, your credit.

10. Never sign blank documents or documents containing blanks. If information is inserted by someone else after you have signed, you could be held liable and bound to the terms of the contract. Always input N/A (not applicable) or draw a line through any blanks. 

11. Understand the loan terms. Understand the total package. Borrowers should compare loan terms from different lenders. Understand the best loan terms available in the marketplace and compare the APR (annual percentage rate) of loans from different lenders. The APR takes into account both the interest rate and the closing costs associated with the loan. Always ask for written estimates that include all closing costs, including all points and fees. The situation may not seem abusive until everyone sets down at the closing table. If any fees or charges differ from what was previously disclosed, delay the closing until all terms of the loan are clearly understood.

12. Read everything carefully and never hesitate to ask questions. NEVER sign anything you don't understand. If you are unsure about what you are signing, it is always recommended that you have the agreement reviewed by a skilled mortgage attorney or trusted real estate professional.
